Welcome to SPARKFLARE DESIGNS. These Terms & Conditions govern your access to and use of our online store and your purchase of our products and services, including customised laser-engraved coasters, keychains, gift boxes and other personalised items.

By placing an order with us, you acknowledge that you have read and understood these Terms & Conditions.

1. Products and Customisation

SPARKFLARE DESIGNS offers ready-made and customised products. Depending on the product, customisation may include names, text, logos, photographs, artwork, illustrations and other customer-provided designs.

Customers are responsible for ensuring that all customisation details submitted to us are accurate, complete and suitable for engraving.

Please note that:

• Product photographs, mock-ups and digital previews are for illustrative purposes.
• Actual engraving results may vary slightly due to material characteristics, surface texture, grain, colour, laser settings and the nature of the supplied artwork.
• Minor variations in engraving depth, contrast, positioning or finish may occur and do not automatically constitute a defect.
• Product dimensions, materials and available customisation options will be stated in the relevant product listing or confirmed before order acceptance.

We will make reasonable efforts to produce the item in accordance with the agreed specifications.

2. Orders and Customer Approval

Orders are subject to acceptance and confirmation by SPARKFLARE DESIGNS.

For customised orders, customers must provide the required text, images, artwork, product specifications and other relevant details before production.

Where a design proof or mock-up is provided for approval, customers must carefully check all names, spelling, dates, numbers, layout and other customisation details.

Production will proceed based on the final design and specifications approved by the customer.

Once production has commenced, changes or cancellations may not be possible. Any request to amend or cancel an order will be assessed based on the production stage, materials used and costs already incurred, subject to applicable consumer rights under Malaysian law.

We reserve the right to decline or cancel an order where the requested customisation is unlawful, infringes third-party rights, is technically unfeasible or cannot reasonably be fulfilled. Where payment has been collected for an order we cannot fulfil, any applicable refund will be provided in accordance with Malaysian law.

3. Pricing and Payment

All prices will be displayed in Malaysian Ringgit (MYR), unless otherwise stated.

The applicable product price, customisation charges, shipping fees and any other applicable charges will be communicated before the customer completes the purchase.

Orders may require full payment in advance unless alternative payment terms have been expressly agreed in writing.

Production will generally commence after payment has been received and the required customisation details have been confirmed.

SPARKFLARE DESIGNS reserves the right to correct genuine pricing or listing errors before accepting an order. If an order has already been paid for and cannot be fulfilled at the agreed price, the customer will be contacted to discuss the available options, including a refund where appropriate.

4. Customer-Supplied Artwork and Intellectual Property

Customers who submit photographs, logos, drawings, text or other artwork represent that they own the necessary rights or have obtained the permission required to use and reproduce those materials.

Customers must not submit content that infringes copyright, trademarks, privacy rights, publicity rights or other applicable laws.

SPARKFLARE DESIGNS may refuse to reproduce content that we reasonably believe is unlawful, infringing, misleading or otherwise inappropriate.

Customers retain ownership of their original artwork and intellectual property. By submitting artwork, customers grant SPARKFLARE DESIGNS a limited, non-exclusive permission to use, reproduce, modify as necessary for production, and store that material solely for fulfilling the order, handling customer service and meeting applicable legal obligations.

This permission does not automatically grant SPARKFLARE DESIGNS the right to use customer artwork for advertising, social media, portfolios or other promotional purposes. Separate permission will be requested for such uses.

5. Production Time and Delivery

Estimated production and delivery times are provided in the product listing, checkout process or order confirmation.

Production time and courier transit time are separate. Estimated delivery dates are not guaranteed unless expressly agreed otherwise in writing.

Delays may arise from design revisions, late customer approvals, material availability, production complexity, courier operations, public holidays, weather or other circumstances beyond our reasonable control.

Customers are responsible for providing accurate delivery details and ensuring that someone can receive the parcel where required.

SPARKFLARE DESIGNS will not be responsible for delivery problems caused by incorrect or incomplete information supplied by the customer, subject to applicable law.

6. Refunds, Returns and Replacements

Due to the personalised nature of customised products, we generally do not accept returns, cancellations or exchanges merely because a customer changes their mind, selects the wrong customisation details, or no longer requires the product after production has commenced.

If an item arrives damaged, materially differs from the agreed specifications, contains a production error attributable to us, or is otherwise defective, customers should contact us promptly with their order details and supporting photographs.

Each complaint will be assessed fairly, and an appropriate remedy will be provided where required by law.

7. Product Care and Intended Use

Customers are responsible for using and maintaining products appropriately according to their materials and intended purpose.

Unless expressly stated in the product description, our products should not be assumed to be food-safe, dishwasher-safe, waterproof, heat-resistant, child-safe or suitable for any specialised application.

Engraving and material finishes may be affected by exposure to moisture, heat, sunlight, chemicals, abrasion or improper handling.

SPARKFLARE DESIGNS shall not be responsible for damage arising from misuse, improper care, unauthorised modification or use contrary to any instructions provided, except where applicable law provides otherwise.

8. Limitation of Liability

To the extent permitted by Malaysian law, SPARKFLARE DESIGNS shall not be liable for indirect or consequential losses arising from the use of our products or services, including loss of anticipated profits, business opportunities or commercial use.

Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited, including applicable statutory consumer rights and liability for fraud, wilful misconduct or other liability that cannot legally be disclaimed.

Where liability may lawfully be limited, our liability will be assessed in accordance with the circumstances, the nature of the loss and applicable law.

9. Privacy and Customer Information

Personal information submitted to SPARKFLARE DESIGNS will be handled in accordance with our Privacy Policy and applicable Malaysian data protection law.

We use relevant customer information to process orders, produce customised items, arrange delivery, respond to enquiries and meet applicable legal obligations.

Customers should not submit sensitive or confidential information unless it is genuinely necessary for the requested service.

10. Unforeseeable Events

SPARKFLARE DESIGNS will make reasonable efforts to fulfil accepted orders. We will not be responsible for delays caused by events beyond our reasonable control, including natural disasters, major transport disruptions, government restrictions, widespread service outages or significant supply-chain interruptions.

Where such an event affects an order, we will communicate with the customer and discuss reasonable available options. This clause does not remove any refund or other rights that the customer may have under applicable law.

11. Changes to These Terms

SPARKFLARE DESIGNS may update these Terms & Conditions from time to time to reflect changes in our business, products, procedures or legal requirements.

The updated version will be published on our online store with its effective date. Changes will not retrospectively remove rights relating to an order already accepted where doing so would be unlawful.
